Terms of Service

Welcome to Tiigo. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Tiigo ("we," "us," or "our") governing your access to and use of the Tiigo mobile application, website, and all related services (collectively, the "Service"). By registering an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately cease using the Service and delete your account.

 

1. Acceptance of Terms and Eligibility

Access to and use of the Tiigo Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

 You must be at least 18 years of age to create an account and use the Service. By using Tiigo, you represent and warrant that you are 18 years of age or older.

 If you are using the Service on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms, and the term "you" shall refer to both the individual user and that entity.

 We reserve the right to verify your eligibility at any time and to suspend or terminate your account if we determine that you do not meet the eligibility requirements.

 Your use of the Service must comply with all applicable local, national, and international laws and regulations. You are solely responsible for ensuring that your use of Tiigo is lawful in your jurisdiction.

 

2. Account Registration and Security

To access the full features of Tiigo, you must create a user account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.

2.1 Account Responsibilities

 You are solely responsible for maintaining the confidentiality of your login credentials, including your password, and for all activities that occur under your account.

 You must notify us immediately at service@teni.love if you suspect any unauthorized use of your account or any other breach of security.

 We will not be liable for any loss or damage arising from your failure to safeguard your account credentials.

 You may not create more than one account per person, use another person's account, or transfer your account to any other person without our prior written consent.

2.2 Account Information

 Your username must not impersonate any person or entity, include offensive language, or violate any third-party rights.

 We reserve the right to reclaim, modify, or remove usernames that violate these Terms or that we determine, in our sole discretion, to be inappropriate.

 

3. Description of the Service

Tiigo is a creative field sketching and inspiration recording platform designed to help users develop and maintain a daily artistic practice. The Service includes the following core features:

 Daily Check-in System: Users may complete Solo Check-ins for independent creative practice or Co Check-ins with other registered users, earning streak records and Coins rewards upon completion.

 Check-in Calendar: A monthly calendar interface displaying check-in history, including completed days, missed days, and make-up sessions purchased with Coins.

 Community: A shared space where users may upload, browse, comment on, and interact with sketches and field study works created by other members of the Tiigo community.

 Inspiration Library: A curated collection of creative guidance content organized into Fundamentals and Advanced tiers, accessible for free or unlockable with Coins.

 Messaging and Communication: Direct messaging between users, including text, quick-reply shortcuts, and voice or video call functionality.

 Statistics and History: Personal dashboards displaying streak data, session counts, practice minutes, community posts, and check-in history.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

 

4. User Conduct and Prohibited Activities

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use of the Service. The following activities are strictly prohibited:

4.1 General Prohibited Conduct

 Posting, transmitting, or sharing any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable

 Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity

 Engaging in any form of harassment, bullying, stalking, or targeted abuse of other users

 Using the Service to distribute spam, chain messages, unsolicited commercial communications, or malicious software

 Attempting to gain unauthorized access to any part of the Service, other user accounts, or our systems or networks

 Scraping, crawling, or otherwise harvesting data from the Service without our express written permission

 Using automated bots, scripts, or other automated means to interact with the Service

4.2 Content Restrictions

 You may not upload, post, or share content that infringes any third-party intellectual property, privacy, or publicity rights

 Content depicting or promoting illegal activities, violence, self-harm, or discrimination based on race, ethnicity, gender, religion, or other protected characteristics is prohibited

 Nudity, sexually explicit content, or content of a sexual nature is strictly prohibited on the platform

 

5. User-Generated Content (UGC) Policy

Tiigo enables users to create, upload, and share original artistic content within the Community. The following terms govern all user-generated content submitted to or shared through the Service.

5.1 Content Ownership and License Grant

 You retain full ownership of all original content you create and upload to the Service, including sketches, field notes, captions, and comments ("Your Content").

 By submitting Your Content to the Service, you grant Tiigo a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to host, store, display, reproduce, modify (for formatting purposes only), distribute, and publicly perform Your Content solely in connection with operating and promoting the Service.

 This license terminates when Your Content is permanently deleted from the Service, except to the extent that it has been shared with others who have not deleted it, or as required by law.

 You represent and warrant that you own or have all necessary rights and permissions to grant the above license, and that Your Content does not violate any third-party rights or applicable laws.

5.2 Content Standards and Responsibility

 You are solely responsible for Your Content and the consequences of posting or sharing it. We do not endorse any user-generated content or any opinion, recommendation, or advice expressed therein.

 Your Content must comply with all applicable laws and must not violate these Terms or our Community Guidelines.

 You must not post content that reproduces copyrighted material without authorization, misrepresents the origin of content, or falsely implies endorsement by Tiigo or any third party.

5.3 Content Moderation and Removal

 We reserve the right, but not the obligation, to review, monitor, remove, edit, or disable access to any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

 Users may report content they believe violates these Terms using the in-app reporting feature. We will review reports in a timely manner and take appropriate action.

 We may suspend or terminate accounts that repeatedly post content that violates these Terms.

 Removed content may be retained in our systems for a limited period for legal and compliance purposes before permanent deletion.

 

6. Minors, Child Safety, and Child Sexual Abuse and Exploitation (CSAE)

The safety and protection of minors is of paramount importance to Tiigo. We maintain a strict zero-tolerance policy toward any content or behavior that endangers, exploits, or harms children in any way.

6.1 Age Restriction

 The Service is strictly intended for users aged 18 and above. By creating an account, you confirm that you are at least 18 years old.

 We do not knowingly permit individuals under the age of 18 to register or use the Service. If we discover that a user is under 18, we will immediately terminate their account and delete all associated data.

 If you believe a minor has created an account on Tiigo, please contact us immediately at service@teni.love so we may take prompt action.

6.2 Child Sexual Abuse and Exploitation (CSAE)

 Tiigo maintains an absolute zero-tolerance policy toward child sexual abuse material (CSAM) and any content or conduct that sexually exploits, abuses, or endangers minors in any form whatsoever.

 It is strictly prohibited to upload, share, distribute, solicit, or otherwise engage with any content that depicts, promotes, facilitates, or glorifies the sexual abuse or exploitation of minors, including but not limited to imagery, text, illustrations, or any other media format.

 Any user found to be posting, sharing, or distributing CSAM or engaging in grooming behavior, sexual solicitation of minors, or any other form of child sexual exploitation will be immediately and permanently banned from the Service.

 We will report all confirmed instances of CSAM or child sexual exploitation to the relevant law enforcement authorities, including the National Center for Missing and Exploited Children (NCMEC) and any applicable regional authorities, without exception.

 We actively employ content moderation measures, including automated detection tools and human review, to identify and remove CSAE-related content. We cooperate fully with law enforcement investigations related to child safety.

 Users who encounter any content they suspect constitutes child sexual abuse or exploitation must report it immediately through the in-app reporting feature or by contacting service@teni.love. You may also report directly to your local law enforcement or the NCMEC CyberTipline at www.missingkids.org.

 

7. Coins System and Virtual Currency

Tiigo features a virtual currency system called Coins, which users may earn through daily activity or acquire through in-app purchase. Coins may be used to unlock premium Inspiration Library content and to purchase make-up check-ins for missed days.

7.1 Nature of Coins

 Coins are a virtual, non-monetary reward currency with no real-world monetary value. They are not redeemable for cash, credit, or any form of real-world currency.

 Coins do not constitute property and do not accrue interest. They exist solely within the Tiigo platform and have no value outside of it.

 We reserve the right to modify the value, availability, earn rates, or redemption options of Coins at any time with reasonable prior notice.

7.2 Earning and Spending Coins

 Coins may be earned by completing daily Solo or Co Check-ins and through other activities as determined by Tiigo from time to time.

 Coins may be spent to unlock premium content in the Inspiration Library or to retroactively fill missed check-in days in your calendar.

 Coins have no expiration date under normal circumstances; however, Coins associated with a terminated or deleted account are forfeited immediately and permanently.

7.3 In-App Purchases

 Certain features or Coins packages may be available for purchase through the Apple App Store or Google Play Store. All purchases are subject to the payment terms of the applicable platform.

 By completing a purchase, you authorize the charge to the payment method associated with your App Store or Google Play account.

 All purchases are final and non-refundable except as required by applicable law or as set forth in the Refund Policy below.

7.4 Refund Policy

 Refunds for in-app purchases are governed by the refund policies of Apple App Store or Google Play Store, as applicable. Tiigo does not independently process refunds for purchases made through these platforms.

 To request a refund, you must submit your request directly through the relevant platform's support channels: Apple support at reportaproblem.apple.com, or Google Play support at play.google.com/store/account.

 Tiigo may, at its sole discretion, provide account credits or Coins as a goodwill gesture in cases of technical error or service disruption. Such credits are not a guarantee or admission of liability.

 Fraudulent chargebacks or disputes filed in bad faith may result in immediate account suspension and referral to relevant authorities.

 

8. Intellectual Property Rights

All content, features, and functionality of the Tiigo Service that is not user-generated, including but not limited to the Tiigo name, logo, app design, graphics, text, software, databases, and Inspiration Library content, is owned by or licensed to Tiigo and is protected by applicable intellectual property laws.

 You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Tiigo-owned content without our express prior written consent.

 The Tiigo name and logo are trademarks of Tiigo. You may not use our trademarks in any manner that is likely to cause confusion, disparage us, or imply endorsement without our written permission.

 We respect the intellectual property rights of others and expect our users to do the same. If you believe that your copyrighted work has been reproduced or distributed on the Service in a way that constitutes copyright infringement, please contact us at service@teni.love with a detailed description of the alleged infringement.

 We reserve the right to remove allegedly infringing content and to terminate the accounts of repeat infringers in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

 

9. Community Guidelines and Social Features

Tiigo's community features are designed to foster a supportive, respectful, and inspiring environment for creative practice. All users are expected to engage with the community in good faith.

 When interacting with other users through comments, direct messages, or co-sessions, you must treat others with respect and refrain from any form of harassment, intimidation, or hostile behavior.

 You may block other users at any time. Comments from blocked users will be automatically hidden from your view. Blocking does not prevent the other user from viewing your public content.

 Direct message conversations are private; however, reported messages may be reviewed by our moderation team in accordance with our Privacy Policy.

 Voice and video call functionality is provided for the purpose of facilitating creative collaboration. Calls may not be used for illegal purposes, harassment, or distribution of prohibited content.

 We reserve the right to moderate, restrict, or remove community content and to suspend or terminate accounts that create a hostile or unsafe environment for other users.

 

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and handling of your personal information is governed by our Privacy Policy, which is available within the app and on our website. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

 You are responsible for ensuring that any information you share publicly on the platform, including your username, profile photo, and community posts, is information you are comfortable making available to other users.

 We implement reasonable security measures to protect your personal information; however, no system is completely secure. You use the Service at your own risk.

11. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites, services, or platforms that are not owned or controlled by Tiigo.

 We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.

 Your use of any third-party service is governed by that service's terms and conditions and privacy policy. We encourage you to review the terms of any third-party service before using it.

 The inclusion of any link to a third-party service does not constitute an endorsement, sponsorship, or recommendation by Tiigo.

 In-app purchases are processed through the Apple App Store or Google Play Store. These transactions are subject to the terms and conditions of those platforms. Tiigo does not have access to or store your payment card information.

 

12. Termination and Suspension

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe that you have violated these Terms.

12.1 Termination by Tiigo

 We may suspend or terminate your account immediately and without prior notice for violations of these Terms, including but not limited to: posting prohibited content, engaging in fraudulent activity, abusing the Coins system, or violating any applicable law.

 Upon termination, your right to use the Service will immediately cease. Any Coins balance in your account at the time of termination will be forfeited without compensation.

 We may also terminate inactive accounts that have not been accessed for a period of 12 consecutive months, with prior notice where practicable.

12.2 Termination by You

 You may terminate your account at any time by using the account deletion feature within the app or by contacting us at service@teni.love.

 Upon account deletion, your personal data will be processed in accordance with our Privacy Policy. Content you have posted to the Community may remain visible until it is removed pursuant to our data retention schedule.

12.3 Effect of Termination

 Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, disclaimers, indemnification, limitation of liability, and dispute resolution.

 

13. Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TENI EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

 Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement

 Any warranty that the Service will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components

 Any warranty regarding the accuracy, reliability, or completeness of any content available on or through the Service, including user-generated content

 Any warranty that defects in the Service will be corrected

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such cases, our warranties are limited to the minimum extent permitted by applicable law.

 

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TENI, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

 Loss of profits, revenue, data, goodwill, or other intangible losses

 Unauthorized access to or alteration of your transmissions or data

 Statements or conduct of any third party on the Service

 Any other matter relating to the Service

IN JURISDICTIONS WHERE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. IN ALL CASES, TENI'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO TENI IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

 

15. Indemnification

You agree to defend, indemnify, and hold harmless Tiigo and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

 Your use of or access to the Service

 Your violation of any provision of these Terms

 Your violation of any third-party right, including any intellectual property, privacy, or publicity right

 Any content you submit, post, or transmit through the Service

 Your violation of any applicable law or regulation

This indemnification obligation will survive any termination of these Terms or your use of the Service.

 

16. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

16.1 Informal Resolution

 Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at service@teni.love. We will attempt to resolve the dispute informally within 30 days of receipt of your notice.

16.2 Binding Arbitration

 If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration, rather than in court, except as provided below.

 You and Tiigo agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.

 Arbitration shall be conducted by a recognized arbitration body in accordance with its rules. The arbitration shall be conducted in English.

16.3 Exceptions

 Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending resolution of an arbitration proceeding.

 Nothing in this section shall prevent either party from bringing claims to enforce intellectual property rights in any court of competent jurisdiction.

16.4 Class Action Waiver

 TO THE EXTENT PERMITTED BY LAW, YOU AND TENI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

 

17. Content Reporting and Appeals

Tiigo provides mechanisms for users to report content or accounts that they believe violate these Terms or our Community Guidelines.

 To report content or a user, use the in-app reporting feature located on each post or profile, or contact us at service@teni.love.

 When you submit a report, we will review it in a timely manner and take action as appropriate, which may include issuing a warning, removing content, or suspending an account.

 If your content is removed or your account is suspended, you may submit an appeal by contacting service@teni.love with the subject line "Content Appeal" or "Account Appeal" within 30 days of the enforcement action.

 We will review all appeals in good faith and respond within a reasonable timeframe. Our decision on appeals is final.

 

18. Service Availability and Modifications

We aim to provide a reliable and continuously available Service; however, we do not guarantee uninterrupted access.

 We may perform scheduled or emergency maintenance that temporarily interrupts access to the Service. Where possible, we will provide advance notice of scheduled downtime.

 We reserve the right to modify, update, or discontinue any feature or aspect of the Service at any time. We will provide reasonable notice of material changes where feasible.

 We are not liable for any loss or inconvenience resulting from temporary service interruptions, updates, or permanent discontinuation of any feature.

 

19. Export Controls and Compliance

You agree to comply with all applicable export control laws and regulations in connection with your use of the Service.

 You represent that you are not located in, under the control of, or a national or resident of any country subject to a trade embargo or sanctions program maintained by your national government or international bodies.

 You agree not to export, re-export, or transfer any Tiigo software, technology, or content in violation of applicable export laws.

 

20. Force Majeure

Tiigo shall not be liable for any failure or delay in performance under these Terms that is caused by circumstances beyond our reasonable control, including but not limited to:

 Acts of God, natural disasters, or extreme weather events

 Government actions, civil disturbances, or national emergencies

 Failures of third-party infrastructure, including internet service providers, cloud platforms, or communication networks

 Cyberattacks, distributed denial-of-service (DDoS) attacks, or other malicious acts by third parties

In the event of a force majeure event, we will make reasonable efforts to resume normal operations as soon as practicable and to notify users of any significant disruption.

 

21. Feedback and Suggestions

We welcome and encourage user feedback to improve the Service. If you submit ideas, suggestions, feedback, or other materials to us ("Feedback"):

 You grant Tiigo a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and incorporate your Feedback into the Service without any obligation of confidentiality or compensation to you.

 You represent that your Feedback does not infringe any third-party intellectual property rights and that you have the right to grant the above license.

 Feedback can be submitted to service@teni.love or through any in-app feedback mechanism.

 

22. Entire Agreement and Severability

These Terms, together with the Privacy Policy and any other legal notices published by Tiigo on the Service, constitute the entire agreement between you and Tiigo concerning the Service and supersede all prior agreements, representations, and understandings between you and Tiigo.

 If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

 Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision unless acknowledged and agreed to by us in writing.

 

23. Amendments to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through one or more of the following methods:

 Displaying a prominent notice within the app

 Sending a push notification to your registered device

 Sending an email to the address associated with your account

Changes will take effect no sooner than 14 days after we provide notice, except for changes required by law or addressing new features, which may take effect immediately. Your continued use of the Service after the effective date of any revised Terms constitutes your binding acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account before the changes take effect.
